Alabama Supreme Court grants permission to carry execution through Nitrogen Hypoxia

Attorney General of Alabama, Steve Marshall sought a date from the Alabama Supreme Court for carrying out the execution of an inmate Kenneth Eugene Smith through Nitrogen Hypoxia. This method has not been used in implementing the death sentence before. "It is a travesty that Kenneth Smith has been able to avoid his death sentence for nearly 35 years after being convicted of the heinous murder-for-hire slaying of an innocent woman, Elizabeth Sennett," Marshall said with regard to his request in court. 

Increase in concentration of Nitrogen in the atmosphere can cause dizziness, headache, numbness and cause restriction in mobility. Excess Nitrogen causes death due to asphyxia 

Smith had asked for a stay in execution as he had opposed lethal injections as a means for it. The petition was rejected by the court but the execution could not be carried out as his body had rejected the injections. 

In May the Supreme Court granted the permission to carry out the executions through Nitrogen Hypoxia. Smith was hired to kill the wife of pastor Charles Sennet in order to claim insurance money. The murder was made to look like a botched up robbery however investigations began pointing fingers towards Charles Sennet. Charles Sennet killed himself before being tried for his crimes.
