Bengaluru court quashes IPC 354A charge against H.D. Revanna in sexual assault case, citing delayed complaint; case under sexual harassment provision dismissed

Bengaluru’s 42nd Additional Chief Metropolitan Magistrate (ACJM) Court has provided relief to former minister H.D. Revanna in a sexual assault case, ruling that charges under Section 354A of the Indian Penal Code (IPC) cannot be entertained due to delay in filing the complaint.

The case was initiated by a woman from Holenarasipur, who had accused Revanna of sexual harassment. Revanna was previously arrested in connection with the allegations, but the High Court had already quashed one of the two sections under which he was booked. On Monday, Judge K.N. Shivakumar of the 42nd ACJM Court refused to take cognizance of the remaining charge under Section 354A, effectively dropping the case against him under this provision.

Background of Section 354A

Section 354A of the IPC defines sexual harassment and lists specific acts that constitute the offence. These include nonconsensual physical advances, demands for sexual favours, showing obscene material against a woman’s will, and making sexually suggestive remarks.

The law prescribes punishments ranging from imprisonment up to three years, fines, or both for offences involving physical advances, demands, or obscenity. For sexually suggestive remarks, the punishment may extend to one year of imprisonment, fines, or both.

Court’s Reasoning

The court’s decision was based on the delay in filing the complaint, which it deemed sufficient grounds to dismiss the charge under Section 354A.
