FIR filed against retired RTO official for issuing over 10,000 fitness certificates without inspection in Bengaluru

HSR Layout Police register criminal case after official inquiry reveals large-scale violations, alleged collusion, and major loss to the Transport Department.

The HSR Layout Police have registered an FIR against a retired Senior Motor Vehicle Inspector for allegedly issuing more than 10,000 vehicle fitness certificates without conducting mandatory physical inspections, causing substantial loss to the Transport Department.

The case is based on a complaint filed on February 28, 2026, by the Regional Transport Officer (RTO) of Peenya Layout, Bengaluru, against Nisar Ahmed, who retired from service on January 31, 2026, after nearly eight years of service.

According to the complaint, during his tenure from August 1, 2025, to January 31, 2026, Nisar Ahmed allegedly issued Form 38(A) fitness certificates to about 10,210 out-of-State vehicles without physically inspecting them, as required under the Motor Vehicles Act. The illegal issuance reportedly violated mandatory inspection norms and procedural safeguards.

The irregularities surfaced after a formal complaint was submitted by advocate N. Nataraj Sharma, President of the Federation of Karnataka State Private Transport Association, to the Transport Commissioner. Acting on this, the Commissioner ordered a detailed inquiry by the Joint Transport Commissioner.

On February 19, 2026, officials conducted a comprehensive data verification exercise and retrieved records related to 10,210 vehicles from the department’s digital system. The inquiry found that Form 38(2) certificates were issued in violation of prescribed rules, and that 41 vehicles registered in Gujarat had also been granted fitness certificates illegally. Based on preliminary findings and official email communications, Nisar Ahmed was placed under suspension on January 20, 2026, even before his retirement.

Following the inquiry, the Joint Transport Commissioner submitted a report on February 27, 2026, recommending criminal prosecution. The Transport Commissioner then ordered the registration of a criminal case, after which the RTO filed a formal police complaint.

The FIR alleges criminal breach of trust, cheating, and abuse of official position, claiming that certificates were issued without physical verification and allegedly in collusion with vehicle owners, leading to wrongful financial loss to the Transport Department. Further investigation is currently underway.
