The UCC, if passed and implemented envisages an even playing field for all citizens irrespective of their religion. It covers areas like marriage, divorce, maintenance, inheritance, adoption and succession of the property.
Article 44 of the Indian Constitution
One can find a mention of the term Uniform Civil Code in Article 44 of the Indian Constitution. It states: “The State shall endeavour to secure for the citizens a uniform civil code throughout the territory of India.”
What UCC means in layman’s terms
As stated earlier, the UCC, when implemented, proposes to be a law that applies to all sections of the society, irrespective of their religion, gender and even sexual orientation.
One should note that the fundamental principle behind this proposed law is that religion and law are not connected.
Marriage, divorce, maintenance, inheritance, adoption and succession of the property are the areas which the proposed law covers.
Drafting of UCC
Long ago, when the framers of the Indian Constitution touched upon the topic of UCC, they received backlash owing to the issue that it touches upon the sensitive issue of religion, among others.
That is precisely why the framers decided to include it in the Directive Principles of State Policy (DPSP). However, DPSP is not enforceable by law.
