Bengaluru man, Awez Khan, sued Apple India and its authorized service centre

iPhone 13 he purchased, its battery and speaker malfunctioned after purchase

Despite warranty, service centre demanded additional payment for the repair

A Bengaluru man, Awez Khan, sued Apple India and its authorized service centre in Indiranagar, and won ₹1 Lakh in compensation.

Khan’s ordeal began when he purchased an iPhone 13 in October 2021, which came with a one-year warranty. Unfortunately, the phone’s battery and speaker malfunctioned shortly after the purchase.

Khan submitted his brand-new iPhone at the iPlanet Care Centre in Indiranagar. After a few days, the service center staff informed him that the phone was fixed and ready for collection. However, upon inspection, Khan found that the battery and speaker issues persisted. He reported this problem to the staff and requested a proper repair.

Two weeks later, the service center staff contacted Khan, claiming they had discovered a glue-like substance inside the phone. They asserted that this issue was not covered by the warranty and demanded additional payment for the repair.

Khan initially reached out to Apple India through email, but received no response. Frustrated, he decided to take legal action against Apple India, filing a complaint of unfair trade practices with the Bengaluru Urban District Consumer Disputes Redressal Commission in Shantinagar.

In their defence, Apple India argued that the complaint lacked factual basis and attributed the damage to an accident. Nevertheless, the court ruled in favor of Khan, ordering Apple India to pay ₹79,999 as compensation and an additional ₹20,000 for the hardship endured by the customer.
