The Delhi High Court upheld the order of a trial court that dismissed a plea filed by Leena Paulose, wife of conman Sukesh Chandrashekar who is facing charges under the Prevention of Money Laundering Act (PMLA). Leena Paulose had filed a plea opposing the Enforcement Directorate’s decision to sell off 26 high-end luxury vehicles which are alleged to have been bought by Sukesh through money procured by unfair means. “For the accused, if the trial concludes in his favour after several years, he would receive the monetary value rather than a decayed, non-operational, rusted vehicle, almost reduced to junk. This ensures the accused does not suffer any financial loss due to the prolonged judicial process. For the investigating agency, this approach ensures that the value of the seized properties will be available to the investigating agency if the trial concludes in their favour,” the high court observed.

The case was heard by a bench consisting of Justice Swarana Kanta Sharma. The counsel representing Paulose argued that she was suffering from memory loss induced by depression that was caused by isolation in jail and was hence not in a position to recollect the registration details of some of the cars. This argument was however not well received by the court. “She cannot be allowed to take shelter under the pretext that her incarceration in the jail is responsible for distress and depression leading to memory loss, more so when there is no medical evidence to support her claim,” Sharma remarked.
