Tesla Inc., the electric vehicle (EV) giant headed by Elon Musk, has taken legal action against Gurugram-based Tesla Power India Ltd for alleged trademark infringement, according to records from the Delhi High Court. The case arises amidst Tesla's anticipated foray into the Indian market.

Based in Delaware, United States, Tesla has accused Tesla Power India Ltd of unlawfully using the trade names "Tesla Power" and "Tesla Power USA." In response, Tesla Power asserted its prior presence in India and claimed to possess all necessary government approvals, as reported by Reuters.

Tesla Inc. stated in court documents that it first became aware of the Indian company's unauthorized use of its brand name in 2022 and subsequently issued a cease-and-desist notice in April of that year. However, with the alleged infringement persisting, Tesla resorted to legal action.

The Delhi High Court has granted Tesla Power India Ltd three weeks to submit written responses following the presentation of supporting documents. The next hearing is scheduled for May 22.

This development follows Elon Musk's cancellation of his highly anticipated visit to India on April 21, where he was expected to meet Prime Minister Narendra Modi. Shortly thereafter, Musk made a surprise visit to China to advocate for an advanced driver assistance package.

The legal dispute coincides with the Indian government's efforts to attract investment in the EV sector, including a reduction in import duties for electric cars priced at $35,000 or more. This move is seen as a strategic measure to assess the market potential and facilitate Tesla's potential entry into India.
