It is illegal to determine the sex of an unborn child

Prominent Tamil YouTuber Irfan, known for his channel “Irfan’s View” with 4.29 million subscribers, has sparked controversy by posting a gender reveal video for his unborn child. The Tamil Nadu health department has issued a show-cause notice to Irfan, demanding the removal of the video, which revealed the sex of his unborn baby.

On May 18, Irfan uploaded a video documenting his and his pregnant wife’s visit to a hospital in Dubai, where a prenatal sex determination test was conducted on May 2. In the video, Irfan acknowledges that sex determination is illegal in India, citing historical reasons for the ban: “When I was born in 1993, my mother knew my gender. It was not a big issue then. It was stopped because many mad people were discriminating against the female gender,” he explained.

Despite being aware of the legal restrictions in India, Irfan hosted a ‘gender reveal’ party in Chennai, announcing the fetus’s gender to family members. This event, captured in a video uploaded on May 19, drew significant attention and criticism.

The Tamil Nadu health department’s notice emphasizes the legal implications of revealing the sex of a fetus in India, a practice prohibited to prevent gender-based discrimination and sex-selective abortions. Irfan has been asked to remove the video from his channel, highlighting the ongoing efforts to enforce these critical regulations.

Irfan’s case underscores the sensitive nature of gender reveal practices in India, reflecting broader societal challenges and the importance of adhering to laws designed to promote gender equality.

As per the Pre-Conception and Pre-Natal Diagnostic Techniques (PCPNDT) Act of 1994, it is illegal to determine the sex of an unborn child in order to curb female foeticide.
