No stay on appointment of election commissioners

SC says can't assume ECs are corrupt

Decision comes just days ahead of LS elections 2024

The Supreme Court has declined to issue a stay on the law governing the appointment of election commissioners, citing potential chaos just weeks before the elections.

Justices Sanjiv Khanna and Dipankar Datta emphasized that there are no allegations against the newly appointed election commissioners, Gyanesh Kumar and Sukhbir Singh Sandhu, selected under the revised selection panel.

The bench asserted that it cannot assume the law enacted by the Centre is flawed and highlighted the imminent elections, underscoring the importance of maintaining a balance of convenience.

The Chief Election Commissioner and other Election Commissioners (Appointment, Conditions of Service and Term of Office) Bill, 2023, replaced the Chief Justice of India on the selection committee with a Union Cabinet minister, raising concerns about impartiality. After the recent appointments, Congress’ leader in the Lok Sabha, Adhir Ranjan Chowdhury, claimed to have received a list of 212 names for scrutiny the night before the meeting, with only six names shortlisted shortly before the panel convened.
