Karnataka government allows regularisation of minor building plan violations with penalty

The Karnataka government has allowed building owners with minor deviations from approved plans to obtain revised plans after paying a penalty. The order applies to all municipalities, including GBA, for violations within 15% of permitted limits.

This decision, earlier applicable only within the jurisdiction of the Greater Bengaluru Authority (GBA), has now been extended to all urban and local bodies, including town panchayats, municipalities, city councils, and municipal corporations.

According to the new government notification, buildings that have deviated up to 15% from the approved plan will be eligible for a revised plan. However, violations related to Floor Area Ratio (FAR) and car parking must remain within a 5% limit to qualify.

The penalty structure has been clearly defined based on the type of local body and the nature of the building (residential or commercial):

For setback violations:

•    Town Panchayat: ₹1,000 (residential/industrial), ₹1,500 (commercial) per sq.m.
•    Municipal Council: ₹1,200 (residential/industrial), ₹1,800 (commercial) per sq.m.
•    City Council: ₹1,500 (residential/industrial), ₹2,250 (commercial) per sq.m.
•    Municipal Corporation: ₹2,000 (residential/industrial), ₹3,000 (commercial) per sq.m.

For FAR violations:

•    Town Panchayat: ₹1,000 (residential/industrial), ₹1,500 (commercial) per sq.m.
•    Municipal Council: ₹1,200 (residential/industrial), ₹1,800 (commercial) per sq.m.
•    City Council: ₹1,500 (residential/industrial), ₹2,250 (commercial) per sq.m.
•    Municipal Corporation: ₹2,000 (residential/industrial), ₹3,000 (commercial) per sq.m.

In addition, every car parking violation will attract a penalty of ₹5,000.
