A Karnataka forum seeks an Appellate Authority with civil‑court powers to resolve apartment disputes, aiming to boost buyer confidence and governance
A leading forum representing homebuyers and apartment associations has urged the Karnataka government to establish a dedicated Appellate Authority with civil‑court powers to address disputes in residential projects across the state.
The demand comes amid growing concerns over prolonged legal battles, delayed enforcement of rulings, and uncertainty faced by thousands of apartment owners. The forum argues that existing mechanisms for grievance redressal remain inadequate, leaving many associations struggling to resolve issues related to builder compliance, maintenance responsibilities, and ownership rights.
Currently, competent authorities oversee certain aspects of regulation, but the absence of a specialized appellate body has resulted in lengthy litigation and inconsistent enforcement. The proposed Appellate Authority would serve as a higher platform for associations to appeal decisions, ensuring faster resolution of disputes. By granting it civil‑court powers, the body would be empowered to enforce rulings effectively, reducing the burden on regular courts and streamlining governance in the housing sector.

Stakeholders believe such a move would significantly boost buyer confidence, particularly at a time when Karnataka’s urban centers are witnessing rapid growth in apartment projects. Stronger enforcement, they say, would not only protect the interests of homeowners but also improve transparency and accountability among developers.
Experts note that the creation of an appellate mechanism could also align Karnataka with best practices seen in other states, where specialized tribunals have helped reduce case backlogs and improved compliance in the real estate sector.
The forum has submitted its recommendations to the government, emphasizing that decisive action will strengthen governance and provide much‑needed clarity for apartment projects across the state. As urban housing continues to expand, the call for a robust appellate framework is expected to gain further traction among policymakers and residents alike.
